FDCPA Gets New Industry-Approved Amendments
Changes in the FDCPA have been approved by the U.S. Congress and sent to the President to sign into law. The amendments were part of the Financial Services Regulatory Relief bill which was passed this weekend.

This landmark action will provide much needed clarity in the FDCPA, reducing the number of nuisance and technical lawsuits filed against collection agencies over "gray areas" in the FDCPA. The three amendments make the following changes and clarifications to the FDCPA statute:
1) Formal pleadings will not constitute an initial communication under the FDCPA, and therefore, will not trigger the need for validation notice disclosures as otherwise required by the Act.
2) Notices and forms sent by debt collectors, as required by other federal or state statutes or regulations, but not requesting the payment of a debt, will no longer be considered initial communications under the FDCPA. Specifically, this amendment eliminates conflicts with the FDCPA and sending IRS mandated 1099-C forms, Gramm-Leach-Bliley Act privacy notices, and state or federal data security breach notification requirements.
3) The right to collect during the 30-day validation period, in the absence of a consumer dispute, will be codified in the FDCPA statute.
The FDCPA amendments were part of a larger Financial Services Regulatory Relief bill which the House passed last week and the Senate approved Saturday. The bill aims at correcting many outdated or redundant regulations in the financial services and banking industries.
The new amendments also include a provision that certain bad check enforcement firms, such as companies that run pretrial diversion programs for bad check offenders, will not be legally defined as debt collectors for purposes of the FDCPA.
ACA International, the association for credit and collection professionals, has made FDCPA clarification one of its main targets over the past 18 months.
